With regard to new builds, it is often the case that planning permission is granted for construction within the lot line setbacks. Following completion, however, an official notice is issued requiring the removal of all parts of the building that exceed the defined setbacks without recourse to compensation. Furthermore, any increase in value is ruled out – in other words, the developer's rights to compensation are waivered. Notices of this kind can often be found in Land Registry documents. <\/p>\n
